KUALA LUMPUR, 12 Sept 2019 — Seorang pekerja kontrak yang videonya tular berhubung kejadian membunuh kucing yang dipercayai bunting dengan memasukkannya ke dalam mesin pengering di sebuah dobi layan diri, hari ini diperintahkan membela diri terhadap pertuduhan mendatangkan penderitaan yang tidak sepatutnya ke atas haiwan itu.
Hakim Mahkamah Sesyen Selayang, Rasyihah Ghazali membuat keputusan itu terhadap K. Ganesh, 42, selepas mendapati pihak pendakwaan berjaya membuktikan kes prima facie di akhir kes pendakwaan.
“Setelah mendengar dan meneliti saksi pendakwaan dan eksibit-eksibit yang dikemukakan oleh pendakwaan, mahkamah mendapati pihak pendakwaan berjaya membuktikan kes prima facie terhadap pertuduhan yang dikemukakan. Oleh itu, mahkamah memerintahkan tertuduh membela diri,” kata hakim itu.
Mahkamah menetapkan 30 Sept untuk tertuduh membela diri.
Ketika ditanya Hakim Rasyihah berapa saksi pembelaan akan dipanggil memberi keterangan, tertuduh berkata lima termasuk dirinya.
Dia juga memberitahu bahawa peguam yang mewakilinya tidak hadir ke mahkamah hari ini.
“Perbicaraan peringkat pembelaan tetap akan berjalan pada 30 Sept walaupun tiada peguam mewakili kamu,” kata hakim itu.
Hakim Rasyihah turut menjelaskan tertuduh mempunyai pilihan untuk membela diri dengan memberi keterangan secara bersumpah dari tempat duduk saksi, atau keterangan tidak bersumpah dari kandang tertuduh atau memilih berdiam diri.
Lelaki itu bersama-sama seorang lagi yang telah dituduh didakwa dengan kejamnya atau secara tidak munasabah membuat atau meninggalkan untuk melakukan apa-apa perbuatan menyebabkan kesakitan atau penderitaan yang tidak sepatutnya terhadap seekor kucing di premis dobi di Taman Gombak Ria, Batu Caves di sini antara 12.54 tengah malam dan 1 pagi, pada 11 Sept lepas.
Pertuduhan mengikut Seksyen 29 (1) (e) Akta Kebajikan Haiwan 2015 yang boleh dihukum di bawah Seksyen 29 (1) akta sama dan dibaca bersama Seksyen 34 Kanun Keseksaan, yang membawa hukuman denda maksimum RM100,000 atau penjara sehingga tiga tahun atau kedua-duanya, jika sabit kesalahan.
Pendakwaan mengikut akta tersebut adalah yang pertama dijalankan di negara ini sejak ia berkuat kuasa pada Julai 2017.
Seramai lapan saksi pendakwaan memberi keterangan pada perbicaraan yang bermula 30 Ogos 2019. Pendakwaan dikendalikan Timbalan Pendakwa Raya Nurul Ain Shafie dan Roslan Mohd Isa.
Sebelum ini, tular satu rakaman kamera litar tertutup (CCTV) memaparkan tindakan kejam tiga individu yang membunuh kucing yang dipercayai bunting dengan cara memasukkannya ke dalam mesin pengering berkenaan.
Perbuatan tidak berperikemanusiaan tersebut kemudian tersebar di media sosial dan menerima kecaman masyarakat sebelum Persatuan Haiwan Malaysia bertindak membuat laporan polis dan mereka ditahan pihak polis.
