KANGAR, 26 Jun 2019 — Kadar gaji terlalu tinggi dan keuntungan yang diperoleh daripada perniagaan tidak banyak adalah antara alasan yang diberi oleh majikan di Perlis untuk tidak melaksanakan Perintah Gaji Minimum yang dikuatkuasakan kerajaan mulai 1 Jan lepas.
Pengarah Jabatan Tenaga Kerja (JTK) Perlis Iskandar Jassa berkata pemeriksaan yang dilakukan pihaknya mendapati ada segelintir majikan yang masih gagal mematuhi perintah gaji minimum RM1,100 berdasarkan Perintah Gaji Minimum (Pindaan) 2018.
“Kadar gaji minimum atau disebut sebagai gaji pokok RM1,100 itu tidak termasuk elaun (kerja lebih masa dan komisen bergantung kepada majikan) seharusnya dipatuhi oleh majikan. Majikan boleh dikenakan tindakan di bawah Seksyen 43, Akta Majlis Perundingan Gaji Negara 2011,” katanya.
Bercakap kepada pemberita selepas Operasi Pemeriksaan Pematuhan Gaji Minimum sekitar bandar Kangar di sini, hari ini, beliau berkata setakat ini, empat tindakan mahkamah telah diambil terhadap majikan yang didapati gagal mematuhi perintah itu.
Perintah Gaji Minimum Pindaan 2018 dikuatkuasakan mulai 1 Jan lalu yang memperuntukkan kadar gaji minimum yang seragam di seluruh negara.
Iskandar berkata dalam operasi itu, pihaknya juga mengesan ada majikan di negeri ini yang gagal menyediakan kontrak perkhidmatan dan slip gaji secara bertulis kepada pekerja di bawah tanggungan mereka.
Beliau berkata kegagalan majikan berbuat demikian adalah satu kesalahan dan boleh dikenakan tindakan di bawah Peraturan 8, Peraturan Kerja 1957, Akta Kerja 1955.
Iskandar berkata pihaknya akan terus menjalankan pemeriksaan di premis perniagaan secara berterusan bagi memastikan kadar pematuhan gaji minimum dipatuhi majikan.
